and Conditions – The Paper Garden. Bespoke origami creations.
In compliance with the new CCR & Trading Standards Regulations these are my terms and conditions as of 13th June 2014
Quotations & Prices--
Prices for custom made items are not listed on corresponding pictures due to the customer’s privacy. Prices listed do not include p&p unless stated and may vary depending on customisations.
For custom made items our quotations are valid for 30 days from date of issue unless otherwise noted.
Quotations do not include carriage, packaging and shipping costs. These will be estimated initially until goods are ready for dispatch. Any differences between estimated and actual cost will be advised to you before posting. We endeavour to find the most suitable form of shipping and charge the most reasonable price.
We conduct business in Sterling only.
We will not be liable for any import tax incurred at your port of entry and/or by Customs where applicable. (Quotations do not include any of these costs.)
Orders--
A quotation becomes an order when the appropriate deposit is received and/or conformation that the order had been accepted by The Paper Garden.
Items that are ready made will be posted within 3 working days unless otherwise notified.
Custom Made Orders will be made & posted within the agreed time at order. If you have a specific date i.e. birthday/wedding etc., item will be with you no later than 14 days before this agreed date. Providing payment have been received. Unless other arrangements have been made, such as payment on collection.
Deposits are non-refundable on all custom-made goods.
Deposits will be 10% of orders over £30.
Goods will only be dispatched after all funds owing have been received and as such they remain The Paper Garden's property until delivery of said goods. Goods will be presumed unwanted after 30 days of no communication or payment received and the contract will become null and void.
Watermarked pictures of items will be posted on The Paper Gardens Facebook page and website a week after the order has been posted. If you are happy for this to be done sooner please let us know. (Cost will not be displayed)
Items ordered but not paid for 30 days after Invoice has been issued, will be deemed unwanted and resold to recoup funds.
Cancellations –
Cancellations are to be sent in via The Paper Gardens website or emailed to [email protected] and will be accepted only before any work has commenced. Once a service has started then the consumers cancellation rights will end.
Each circumstance will be viewed on its merits and it is The Paper Garden's sole discretion at that time.
Payment-
Payment is made via Bank Transfer, Cash, or PayPal. As stated when you placed your order you will be sent final pictures of your item before it is posted for your approval. This will be your opportunity to check for errors, minor changes/additions etc. Once approved your item will be packed and once payment has been received, item will be posted, or cash exchanged on collection.
Shipping-
All prices do not include postage. Postage is charged depending upon weight and size of items purchased. In most situations will be posted first class by Royal Mail, however if very heavy, a courier will be used to save on postage costs. If you have a specific date that you need your items by please advice at booking. If I do not think I can make yo9ur order in time I will not accept the order and explain why. If you do not have a specific date for your item, your order will go into the order list and you will be advised approx. how long it may take. If for whatever reason it takes me longer to fulfil your order than I expected I will advise you off that and you are welcome to cancel the order at that point.
Please allow extra time for delivery at the busiest times of year, i.e. holidays and seasonal events (Fathers/Mother’s Day etc.).
Proof of posting will always be supplied, but I cannot be held responsible for things going missing in the post using this service.
Refunds and Exchanges –
No returns accepted or refunds given on custom made items. Photographs of any item will be sent to allow you to approve or change along the way. Final pictures will be sent to you before the item is posted to ensure you are happy. Please ensure that you check your design thoroughly before approving it.Returns and refunds on non-customised and ready-made items. Returns are accepted within 14 days of receipt of item and notification to The Paper Garden. Refunds will only be issued once product is received by The Paper Garden and not before. The refund will equal the price paid for the item and not the coverage of postage.
We reserve the right to decline to provide replacement or repaired items to you and instead refund any monies you have paid to us.
These terms are written in accordance with the New Distance Selling Regulations or Consumer Contracts Regulations that took effect as of 13th June 2014.

General:--
All other warranties, whether express or implied, by statute or otherwise are excluded to the fullest extent permitted by law.
In the event of any breach of contract, your remedies shall be limited to damages and under no circumstances shall our liability exceed the price of the item (s) made by us and, if not included in the price, the cost of the materials (excluding delivery charges).
Such Contract between us shall be treated as though it were executed and performed in the United Kingdom and shall be governed by and construed in accordance with the laws of the United Kingdom. All actions shall be subject to the limitations set forth in the Terms and Conditions as provided in this document.
The language used herein shall be interpreted as to its fair meaning and not strictly for or against any party. All legal proceedings arising out of or in connection with this Contract shall be brought solely in the United Kingdom and the Customer expressly submits to the jurisdiction of said courts and the Customer consents to extra-territorial service of process. Should any part of this Contract be held invalid or unenforceable, that portion shall be construed consistent with applicable law as nearly as possible to reflect the original intentions of the parties and the remaining portions shall remain in full force and effect. To the extent that anything in or associated with the website or The Paper Garden is in conflict or inconsistent with this Contract, this Contract shall take precedence.
Failure by The Paper Garden to enforce any provision of this Contract shall not be deemed a waiver of such provision nor of the right to enforce such provision. Nothing in this contract should be deemed to remove any of your statutory rights as a consumer.
